Burn Permit Rules and Regulations

Reviewing these requirements will help ensure that your burning activities remain safe and in compliance with state law.

A burn permit is not required for open burning that involves:

Recreational fires less than three feet in diameter and located more than 25 feet from any structure (including solo stoves and commercially manufactured fire pits).
Outdoor fires used solely for cooking when located more than 25 feet from any structure.

I understand that open burning can not occur within 25 feet of any structure:

I understand that Open burning cannot occur within 500 feet of any other occupied property that is not owned by the person requesting open burning.

I understand that burning must be controlled so as to avoid creating a traffic hazard on any public road, street, or highway as a result of the air contaminants emitted; Only natural vegetation and untreated wood will be burned.

I understand that initial burning may only start between 8AM and 3 PM, no additional material can be added after 3 PM.

I understand that burning shall be conducted only when there is good ventilation and when the prevailing wind direction is away from any built-up area in the vicinity.

I understand that no burning shall be conducted in areas under a current air stagnation advisory issued by the National Weather Service or during a "Drought Emergency" declared by the Governor.

I understand that the fire shall be attended at all times with a least a fire extinguisher or water hose.

I understand that Oneonta Fire & Rescue Service has the right to extinguish any fire that is deemed a public safety or health hazard upon inspection as noted in City of Oneonta Code Chapter 9-1

This permit does not supersede any City, County, State, or Federal requirements. This permit is subject to all laws, rules, and regulations of the City of Oneonta and may be revoked without prior notice upon failure to comply with any of the above Rules of Burning or if judged hazardous by the Fire Official.

I certify that only natural vegetation will be burned at the location described in this application. I understand that burning any other materials — including but not limited to lumber, pallets, cardboard boxes, furniture, plastics, construction debris, or other manufactured items — is strictly prohibited. I agree to comply with all applicable burn regulations and acknowledge that failure to do so may result in penalties or revocation of the burn permit.
